BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned an alley located northeast from Boylston Street, southeast of Forest Avenue, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: A 10 foot wide unopened alleyway beginning on the northeast line of Boylston Street 147.9 feet southeast of the intersection of the northeast line of Boylston Street with the southeast line of Forest Avenue, thence northeast 289.5 feet parallel to Forest Avenue to the west line of Liberty Street, thence south some 12 feet with Liberty Street to the northeast corner of lot 8, block 24, Map 1, North Chattanooga, Property of the Chattanooga Land, Coal, Iron and Railway Company, as shown by plat of record in plat book 3, page 31, R.O.H.C., thence southwest 277 feet parallel to Forest Avenue to the northeast line of Boylston Street, thence with Boylston Street northwest some 10 feet, and northwest some 8 feet to the point of beginning. Said alleyway separates lots 1-7, block 24, from lots 8-10, block 24, said Chattanooga Land, Coal, Iron and Railway Company subdivision. Tax Map No. 126M-R-1, 2, 3, 4, 5, 23, and 24. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The City of Chattanooga has a sewer located within the right-of-way and reserves an easement the width of the right-of-way for the purpose of maintaining said sewer. 2. Reservation of an easement the width of the right-of-way for South Central Bell for the purpose of operating and maintaining its facilities in said right-of-way. 3. The areas reserved for utility easements must be kept free and clear of all structures. 4. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law.
